Little Annie's deed finalized

A landlord’s attempt to increase rent on an Aspen restaurant was stopped by elected officials Monday night.

In 2012, Little Annie’s was saved from demolition when city council gave Aspen Core LLC - controlled in part by father and son duo Andy and Nikos Hecht - variances to the land use code on a building next door in exchange for preserving the downtown restaurant. A deed restriction ensured that the rent would be capped with the condition that affordable menu items remained.

At issue during last night’s meeting was if the 2012 resolution included common area maintenance fees, or if the stated $9500 a month in rent was the total cost owed to the landlord.

City Manager Steve Barwick, told council the original concessions to the developers came with a clear understanding for the Little Annie's property.

 

The council unanimously agreed that the landlord can’t pass expenses like insurance, maintenance or management fees onto the business. The deed restriction allows for the rent to increase according to the consumer price index, which today translates into $9800 a month.
