Basalt resident files response to open records lawsuit

A Basalt woman said the Town of Basalt filed a lawsuit under the wrong statute. The town sued resident Mary Kenyon April 29 over her previously filed open records request.

At issue are deleted text messages between the town clerk and mayor Jacque Whitsitt. Kenyon formally responded to the suit Friday, saying that – among other things – Basalt’s lawsuit erroneously cites a law used when someone’s changing their name.

“It’s been a horrible experience,” Kenyon said after filing her answer with Eagle County District Court. She researched statutes, case law and gathered evidence in order to prepare.

“It took me probably 20 hours of time, and then I had to drive over to Eagle County, had to pay $158 for the honor of answering this complaint.”

Kenyon is also a marketing consultant with the Town of Basalt. A judge with Eagle County District Court is expected to review the case.
